Why is a Florida Process Server Bond Required?

The Florida process server surety bond's purpose is to prevent purposeful fraud from a certified process server.

When the Fifteenth Judicial Circuit issues your certification, it's essentially a signal that you are qualified to be a process server. And because they are issuing you this certification, they want to hold you accountable to the state laws.

This surety bond is the only tool they have to hold all process servers accountable.

It's unfortunate but every year there will be a small number of process servers that purposefully commit fraud operating their business.

Examples of fraudulent actions can include:

  • Serving the wrong person to delay a case
  • Not verifying the serving process opening the process for a contest
  • Essentially delaying any part of the process to benefit a preferred party

If a process server is found guilty of purposeful fraud, the opposing party in a legal action or the party who hired the process server could make a claim against the surety bond for financial damages.

So again, the process server surety bond is required to deter these actions from taking place.
