Why is a Mississippi Title Bond Required?

A title bond is required when proof of ownership for a vehicle is not verifiable. Examples of scenarios when this is the case include:

A bonded title is just like a standard vehicle title. It reestablishes the line of ownership for a vehicle when the original title has been:

  • Damaged making it illegible
  • Filled out incorrectly and missing the original owners name
  • Ownership gaps where owners were not properly recorded
  • Lost
  • Not delivered after purchase

In these cases or any case where you purchase a vehicle and you don't have the original title, you must go through the following process to obtain a bonded title in Mississippi.

 

What is the Mississippi Bonded Title Process?

Mississippi makes the process pretty easy compared to many states. The steps are as follows:

  • Step 1 - Complete your research on the vehicle
  • Step 2 - Get your vehicle value and purchase your title bond
  • Step 3 - Complete the ownership affidavit
  • Step 4 - Provide a bill of sale and have your title issued

Let's go over each step starting with your research on the vehicle because this will answer the following question.

 

Why is a Mississippi Bonded Title Required?

Because a vehicle (or manufactured home) has a missing title, it's impossible to know who the rightful owner is.

Without a rightful owner, this can potentially mean a few things:

  • The vehicle may have been stolen so it can be sold for profit
  • The vehicle owner may have liens and they're trying to make money and avoid paying those liens

It's these situations the Mississippi Department of State is trying to avoid. The last thing they want to do is register a vehicle that truly belongs to somebody else.

And this is why they require a title surety bond and why you need to research the vehicle.

 

What is a Mississippi Title Bond?

A title bond is a type of surety bond.

A surety bond is a legal contract you purchase as a guarantee of some promise. In this case you are promising:

  • The vehicle is not stolen
  • The vehicle is free of any lien

If after receiving your bonded title, a previous owner comes forward with proof they still own the vehicle, they can make a claim against the title bond for financial compensation.

This is why it's so important you search vehicle databases to ensure the VIN number does not register as stolen.

You also search state records to make sure the vehicle has no liens on it. If you find a lien you can contact the lien holder and either:

  • Get a release or the lien
  • Or prove they are no longer at their last address

  • Step 1 - Get the value of your vehicle

Step 1: Get The Value Of Your Vehicle

It's easiest to use one of the following websites to get the value of your vehicle:

If these websites cannot provide you with a value, you can always ask your local police department or a local dealership to help with an appraisal. But in nearly every case, these websites will give you a value.

The value of your vehicle is required because it will tell you the amount your title bond must have, which is 1.5x the value of the vehicle.

For example, if KBB says your vehicle is worth $7,000 you'll need a title bond with an amount of at least $10,500.

We commonly recommend increasing the bond amount by $5,000. So in our example, the bond amount would be $15,500.

In most cases the price to purchase the bond does not change and this ensures there will be no issues having your title bond accepted by the Mississippi Department of Revenue.

If the price does change by adding $5,000 more, we'll simply use the original amount.

Why Do Bond Amounts Over $50,000 Require a Quote?

The larger the title bond amount, the greater the coverage required to bond the vehicle title.

This means if the vehicle was stolen or there was a third party claim on the vehicle, the payout to remedy the situation would much larger. So the surety company underwriting the bond wants to have some measure that a payout will be paid back.

And this is why your personal credit is the primary factor for vehicles valued over $50,000.

So the surety will look at your personal credit as a measure of honesty and faithfulness.

From your credit, they will determine a rate and this rate multiplied by your bond amount is the price you pay.

How Long Does a Bonded Title in Mississippi Last?

Mississippi requires the bonded title to be active for 3 years.

The great news is when you purchase your title bond, it's one payment for all 3 years.

During this 3 year period if any person or business has a legitimate claim for the vehicle, this is their chance to prove it.

After the 3 year waiting period, the Department of Revenue and your local Tag Office will issue you a standard title.

When this happens, the vehicle is officially yours and any future claims of ownership will be deemed immediately invalid.

Step 3: Complete Remaining Paperwork

Once you have your title bond issued, the only remaining steps you must complete are the:

  • Ownership Affidavit which is you legally claiming the vehicle as yours
  • Provide a bill or sale

You need to provide a bill of sale for the vehicle so the Department of Revenue knows you obtained the vehicle through a real transaction.

Remember, the bill of sale is just a paper that proves the vehicle went from one individual to the next. It can have a sale of $0.
